Residents speak out on proposed arrest ordinance

Plum Borough Council heard from two residents and one of its own members Monday night who are against the proposed summary arrest ordinance.

Council will vote on the ordinance Monday, Oct. 8, at 7 p.m. in the borough building.

The ordinance would allow officers to take people into custody when charged with summary offenses -- but only in four specific situations. Officers would be able to take people into custody for public drunkenness, disorderly conduct, underage drinking or blocking a highway.

Both men who spoke out against the idea of a summary arrest said they feared they would be losing their civil liberties. The men also referred to Hitler and the Gestapo in their discussions, but admitted they hadn't read the ordinance yet.

Council members vehemently denied any civil liberties would be lost with the passage of this ordinance.

"Last time I checked public intoxication is a crime, obstructing a highway is a crime," said Mayor Rich Hrivnak, who echoed what Plum Police Chief Frank Monaco said at last month's meeting when the chief told residents no one will lose their rights because no one has the right to break the law.

Dave Vento, councilman, asked why the ordinance is needed if the circumstances it covers are already crimes.

"Just because everyone else does it doesn't mean we need to do it," said Vento. "There are all kinds of ways to arrest someone without a warrant. Laws can be abused by law enforcement."

Don Flickinger, councilman, said the biggest drawback in the ordinance will be the need for the department to monitor itself so it isn't abused. Monaco said last month that if the ordinance is passed he will write policy that will govern how the power is used.

"The law could mean an abuse of power," said Todd McBride, resident. "That's why we're always in the news and under a federal investigation. We're starting to get into a judgment call by the officers with this."

McBride was referring to an ongoing investigation of the police department by the FBI.

"The chief's reasons for wanting this are not too good," said resident Edgar Beruh, who went on to say that if a person continued to defy an officer after a warning it would eventually amount to a misdemeanor offense that would give the officer the right to take the person into custody.

Monaco did not ask council to approve this ordinance, said Paul Dern, councilman, "Council asked to do this because Plum Borough is the only municipality in Pennsylvania that doesn't have this ordinance."

Mike Thomas, borough manager, agreed with Dern and said in most municipalities the ordinance is tougher.

The ordinance is available at the borough building for residents to read before council's voting meeting Monday night.

To me it is not that this is a bad idea but my concerns are with the police department themselves. Lets face it, the Plum Police do not have the greatest rep for "good cops". I do not trust the police in this town. I have needed them a few times and I have been let down everytime. You give these guys more power and they will abuse it.

The person who insulted you was a police officer. Many of these types of badcops actually surf the net on company time.As you can see, he signed on to make one comment and a mindless comment to boot. Ignorance is always blissful. Please pass along a secret we know. There are good cops speaking out against badcops within the department. They are few, but they are there, and they are ashamed at the types of behavior that have been giving them such a bad reputation. They are a silent minority and they must remain publicly quiet as many badcops are truly dangerous. The FBI investigation does continue.

Thank you for letting me know that. How scary is that? These are supposed to be the ones protecting us. I know that there are good cops out there. I moved here in 2005 and the way I see things in this town is that if you do not know somebody, then you are a nobody. I do not trust the Plum cops for anything. I had someone try to break into my house and I never called the cops because I do not feel that they would have done anything about it. But again, thank you for telling me that.

It sounds to me like HaJaMa is pretty much a complete moron. First of all, haven't you only lived in Plum for a little over 2 years?? If you know that much about the Police Department in that little time, you're obviously doing something wrong. I've lived here for 52 years and have NEVER had a runin with the law! Secondly, if you have only lived in Plum for 2 years, NONE of the controversial officers were even here anymore when you moved here!!! Plum's Police Department had a few bad seeds a long time ago, LET IT GO PEOPLE!! They have been doing nothing but good for this town lately and all you ever see in the papers are the bad things that happened a long time ago! GET A LIFE HaJaMa and Karen Zapf! This is a great CLEAN town and that is partly due to the good job our Police Department does.

First of all...I thought this was about our opinion. To just call someone a moron is just showing your character. You must be related to a cop here or something because I also know alot of people that have lived here for a long time and they think the same thing I do. And yes, if I recall, there was just "a bad seed" rehired. I do not know much about what went on here before I came here but I also did not move here from a different country. I lived a few towns away. And I do have a life, it is just people, apparently just like you, that seem to think insulting people is a good thing. Gee..sounds like you maybe used to be a cop. And if this is cleaned up....I am glad I did not live here before. So maybe next time have a little kuth and get your point across without calling people names. Are you still in highschool??
